If god is so empathetic...then why is it we are being judged for an eternity by the actions we take in this sliver of existance?

That question has no meaning unless you believe in God and that He is judging us.
If, like me, you do not believe in God then there is no problem as the question does not arise.

if Steve's God is illogical and incapable of existence, that doesn't mean a certain God with different nature doesn't exist. you can create your own God and worship him for social or self-help purposes or even mind-state or brainwave manipulation.
if created Gods exist in the minds of their creators, then they do exist in fact. for example, if a created god exist in our civilization long enough to the extent of shaping the very behavior of our society, you must be prepared to acknowledge that influence and therefore acknowledge its existence.

do you believe in Law?
Law was invented by men, for good purposes and all that, yet lawyers and courts don't exist in nature. Yet invented, law exists and it can lead you to very material places, like jail for example.
maybe laws were less real 3000 years ago, today they're as real that you have to consider its weight in your actions. gods and religions have similar existences.

but that's only my take on it. it's a strange personal opinion, I admit it, but it gives me great tools for thinking outside the box when needed.

Law does not exist materially. For that matter, neither do nations. They are a set of ideas that people subscribe to (or are subjugated by, depending on who you talk to). They act as guidelines for the ways in which society conducts itself.
The truth is that, if you break a law, and are caught, the judicial system (generally) will punish you for having violated the idea that that law represents. But you will not suddenly find yourself transported to a prison because you were J-walking.
Law and God are both IDEAS. The only difference is in who subscribes to those ideas.
