Does anyone know Jabroni's REAL identity ?




Jabroni:

In light of what you've done, it's high time for you to reveal your REAL identity.

If I can find out, I'll post it here.

I want you to know that I'm not doing this out of any malice towards you whatsoever, but only because if you feel you've been the victim of slander (a crime) and you and your lawyer feel compelled to go to the public Web-host provider servicing Barb's MB to seek re-dress, then those on Barb's MB have a real right to know who you are, esp. since you have not used your real
name there.  Hiding behind the cloak of the 'Net will not protect you in the long run, if this matter does end up in a court of law (as a paralegal, I can guarantee you that).

Of course, for obvious reasons, Barb may not want to further embroil herself in this matter by answering any direct inquiries towards her regarding your true ID, should anyone ask her.  I can definitely understand that, as
you should to.

Until this matter is settled, about the only point that is indisputably known for now is that if Barb's MB is ever back up, you will be banned from ever posting there again.  Of course, I would only assume that you were already
well-aware of this before you decided on your course of action.

As I said, if you're hell-bent on protecting your reputation (and I can also certainly understand that), you need to also know that this is a two-way street, translation:  Only phantom plaintiffs have fake ID's.

It's high time to show yours.

Don't be dumb, Tangler. If you post his real identity on a message board then he might actually have the right to sue. Just relax. I think doing what you propose would only make it worse.

Sheesh Tangler, if you wanted his info, you should of snagged it off Barb's mb. Marty posted an e-mail from the clown, showing the full message header. From just that you could of had anything you wanted from him.

Snooze ya lose. You'd think someone as idiotic as him would try to hide behind Hotmail (nah you really can't hide behind that or any other free mail anymore) but he just used his AOHell account to mail out his threats.....then again, we never said he had a brain.

But you also had a chance to nail this clown to the wall many times previously. All you had to do was take his posts, or e-mails sent out, with threats, slanderous remarks, and his other nonsense, and turned it into AOL. For he broke most all of their T.O.S. with his actions. Take away AOL from a goomer like him, and it's pretty well like slitting his throat.

Ah well, he's seriously not worth putting any effort at all. You can't fix stupid, and you can't polish a turd.

I can follow your reason for caution, but, without "splitting hairs" about it, anyone has the legal right to sue for slander, defamation of reputation, character, etc. The real question is whether or not one has any actual legal grounds (standing) for so doing. This depends a LOT on the time and other circumstances of when and how the "victim" says he/she was slandered.

This means, e.g., you can't use a fake reference (e.g., on a 'Net MB, in a newspaper, or any medium of mass communication) that fails to portray or connect you to a real identity (or, if it also fails to connect you to a real identiy from context or surrounding events) and expect to have legal grounds (standing) for suing for slander if you believe your personal or professional reputation or character is being damaged. If the plaintiff fails to meet these requirements, he/she has a ****-poor chance of proving slander. That's why, if one wants to take advantage of the cloak of the 'Net, that the anonymity of the 'Net itself is a big hurdle to jump for proving slander.

You mention that revelation of Jabroni's real ID would only make matters worse. At this point, such a revelation would be moot because even if Jabroni was only threatening charges of slander, the timeframe for looking into this has finished without his real ID having been revealed during the time the alleged slander took place (in other words, Barb's MB is now off-line). Knowing his real name now wouldn't make any difference one way or the other.

It very well COULD make a difference if his real ID were known AT THE TIME the alleged slander took place. That might give grounds for showing
the merit (or lack of merit) of connecting identity to reputation, character, etc., and for showing damage thereof.

All you've said I can't disagree with, for sure.

Like I said, although I followed all the Jabroni posts and replies from everybody in the beginning, I eventually skipped over just about everything as time went by because I thought it was worthless to continue. So I must have missed over Marty's post showing any e-mail/message header info.

Turning stuff into AOL's investigative dept. over something like this was sure as hell not worth my time (and AOL would probably say not worth it's time, either). It wasn't MY (friendly emphasis) reputation or character that was on the hook, so why would I bother with this business, even if Jabroni was violating any AOL Terms-of-Service (TOS) or Acceptable-Use-Policy (AUP) agreements in place. Now, if I tell you who I really am, and my own personal or professional reputation or character is at stake, that's a different case altogether as far as I'm concerned because I'M (again, fr. emph.) the one who's the victim; otherwise, if there's no real, ulterior harm emanating from such activity that results in dire consequences for me or others in general, there's not much incentive for me to pursue it.

That's about all I can say for that.

And in regards to the "purported" legal action by Jabroni: if he actually tries to bring action against Barb and/or her isp, he will have to reveal his identity in the court documents. I don't think a fictional character, pen-name, or pseudonym can file suit, even in this overly litigeous country. And those records will be public access unless sealed by the court.

As far as Jabby, the man was looking for attention, and you guys by talking about him, continue to stoke him, if he indeed visits here, which I doubt. Marty has been good at keeping us up to date on what's happening at Barbs; if it reopens, great. If it doesn't it really isn't the end of the world is it? It was getting back to it's ugly self right before it closed, IMO, what with the endless threads of flames, and the Jabroni crap.

And to the good Doc Chin, you got some balls showing up here in Dio land. Stay low and keep your eyes and ears to the ground, and trust noone. There's a bounty on you..
