seat belt law opposition

Your qustion about collecting insurance in a traffic accident if a seat belt is not used, is a loaded question which automatically favors "NO" for an answer. You assume not using a seat belt is automatically lethal, which is hogwash. People have been saved from death only because a seat belt was not used. Also, forced seat belt use can result in more injuries or even cause death. You should ask----"Should the government wilingly maim and kill some people through forced seat belt use because the government merely hopes others will be saved by chance?"

the seatbelt law is ridiculous to begin with. People should not be ticketted for an act that is harming noone but themselves. Drivers who dont wear their seatbelt are not this great menace to society who should be ticketted. the seatbelt law is nothing more than a ploy to generate more cash flow in local city halls.
But, however stupid this law is, the 10% of you yuppies that think people should be able to sue for injuries that they would not have recieved had they been wearing a seatbelt, are either misinformed, or just plain stupid.

You never know 100% if a seatbelt would've prevented injury. I am 100% for seatbelt wearing, but there have been cases where if someone had a seatbelt on, it could've hurt or even killed them. You can't make a law like that.

I think Germany has that law in effect, reduced injury compensation to non-wearers.

Same for motorcyclists that choose not to wear helmets: Automatic DNR (do not resuscitate-sp?)

seatbelt liability

We should be wary of too much legislation. This might be another source of corruption. We need to stop exposing our citizenry to all kinds of corruption through legislation.

The money that will compensate accident victims will pad the wallets of insurance companies and legislators who support this kind of legislation.

Disgusted is correct in saying that this is another big stick that the people will hit themselves with, 'on the head'.

SEATBELT / LIABILITY POLL

This agenda only benefits the insurance companies. The Auto Insurance Industry are making a killing with the present schema. This issue will largely increase their profits.

There is another twist to this. The people who are first to respond to crash incidents will be candidates to recieve payoffs from insurance companies. Which should be avoided at all cost. So therefore, to all civic minded citizens, we should be wary of too much legislation. This might be another source of corruption through legislation. Right now that the insurance industry is lobbying for this issue, money will change hands in the legislative body of our country.We need to stop exposing our citizenry and our legislators to all kinds of corruption.

Seatbelts

I don't like wearing them, it affirms that I am going to need it. I have seen plenty of people's lives saved by NOT wearing the "darned" things. They are a money making belt, and I don't think a person should have to wear it. I got my first ticket 3 years ago for not wearing one and I do now, to save money. When I can, I take it off.

I think it's wrong to impose seatbelt laws on us. The use of seatbelts should be a choice, not a law !!! Same with helmets on bikes !!!!

To those who think "no compensation"

The key phrase in this is "injuries that would have been prevented." C'mon, people: do you REALLY want to open that can of worms for the lawyers and our corrupt, unequal court system to mess with? I guarandamtee that if you do get a law saying that those not wearing seatbelts cannot claim compensation, sooner or later you or someone you love will fall victim to that very law, because you're opening the door for them to prevent compensation payment at all from an accident.

For example, maybe your husband or wife unbuckles for "just a second" to deal with a kid mess in the back seat, and in that second you get hit. So your spouse doesn't get compensation, even though you weren't at fault in the actual accident, because he/she wasn't wearing their seatbelt at the time.

So you try to fight it as your medical bills soar higher than your mortgage. Now you have to somehow prove that the seatbelt would *not* have *prevented* his/her injuries... do you see where I'm going with this?

And the only real winners in this would be the insurance companies, who would eat up their "savings" without passing it on to you, their customers.

Let's not give big business and lawyers any more big sticks than they already have to hit us over the head with, okay?

PS: if you want to get vengeance on a bad driver for an accident they caused, sue them directly in civil court; don't try to get a law put in to benefit your insurance company instead of *you*.

Seat Belts and Liability

I was sideswiped by a tractor trailer 3 years ago. My car was lifted up off its suspension, and slammed down again. The force of it herniated six discs in my back (four lumbar; two cervical). I was wearing a seat belt, but it would have made no difference if I was not.

My pointis, SEAT BELTS DO NOT ALWAYS PREVENT INJURY! In some cases, they can actually CAUSE injuries.

Even if I'm not wearing a seatbelt and someone runs a red light and hits me in the side, a seatbelt can't do anything for that and to deny a claim bases on not wearing a seatbelt is ridiculous and irresponsible.

How do you know?

How can you decide what would have been prevented had a seatbelt been worn? If you let the insurance companies start deciding what would have happened if they would never pay a claim again. I had my car broken into because I left it parked overnight at my office. Had I driven it home that night it never would have been burglarized. Is that a reason not to pay the claim?
